Terms of Service

1. Acceptance of terms

By creating a Lucuma account or using the Lucuma service, you agree to these Terms of Service. If you are using Lucuma on behalf of a company or organisation, you confirm you have authority to bind that entity to these terms. If you do not agree, do not use the service.

2. The service

Lucuma is an AI-powered CV screening tool developed by Marvanova. It allows users to screen and categorise candidate CVs against defined criteria. Lucuma is a decision-support tool, it is designed to assist recruiters in prioritising CVs, not to make hiring decisions automatically. All hiring decisions remain the responsibility of the user.

3. Account registration

• You must provide accurate information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorised access to your account
• You may not share account credentials between individuals (each seat requires a user licence on multi-seat plans)
• You must be at least 18 years old to create an account

4. Acceptable use

You agree to use Lucuma only for lawful purposes. You must not:

• Use Lucuma to process candidate data without the legal basis to do so under applicable data protection law
• Use screening results as the sole or determinative basis for rejecting candidates without human review
• Attempt to circumvent, disable or reverse-engineer any part of the service
• Upload malicious files, spam or content that violates applicable law
• Resell or sublicense the service without written permission (except as explicitly permitted under white label arrangements)
• Use the service in any way that could damage, disable or impair the service or interfere with other users

5. AI screening and accuracy

Lucuma uses AI to analyse CV content and assign scores and categories. You acknowledge that:

• AI screening results are probabilistic and may contain errors or omissions
• Lucuma's scores and summaries are intended to assist, not replace, professional recruiter judgement
• Candidates flagged for manual review have not been scored, you are responsible for reviewing these yourself
• You are responsible for verifying any information derived from screening results before acting on it
• Lucuma is not liable for decisions made on the basis of screening results

6. Subscriptions and billing

Free trial

The free trial provides access to Lucuma for 14 days with a limit of 20 CVs per screening run and no payment card required. After 14 days your account enters read-only mode. No charge is applied.

Paid subscriptions

Paid subscriptions are billed monthly or annually in advance. All prices are in GBP and exclude VAT. VAT will be added at the prevailing UK rate where applicable.

Cancellation

You may cancel your subscription at any time from your account settings. Monthly subscriptions: access continues until the end of the current billing period, no refund for the remaining period. Annual subscriptions: you may cancel within 14 days of payment for a full refund. After 14 days, access continues until the end of the annual period and no refund is issued.

Price changes

We will give 30 days' written notice of any price changes. If you do not wish to continue at the new price you may cancel before the change takes effect.

7. Intellectual property

Lucuma and all related software, design, trademarks and content are owned by Marvanova and protected by intellectual property law. These terms do not grant you any ownership rights. You retain ownership of any CV data and job specifications you upload, we claim no rights over your content.

8. White label licences

Agency and Enterprise plan subscribers may rebrand Lucuma with their own logo, name and colours for presentation to clients. This does not constitute a transfer of the underlying technology or intellectual property. You may not represent Lucuma as a product you have independently developed or built.

9. Data and privacy

Our use of your data is governed by our Privacy Policy. Where you upload candidate personal data, you are acting as the data controller and must have a lawful basis to do so. Agency and Enterprise subscribers receive a Data Processing Agreement on request.

10. Availability and support

We aim to keep Lucuma available but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. Enterprise plan subscribers receive an uptime SLA. We reserve the right to modify or discontinue features with reasonable notice.

11. Limitation of liability

To the maximum extent permitted by law:

• Lucuma is provided "as is" without warranty of any kind
• We are not liable for indirect, incidental, special or consequential damages
• Our total liability to you in any 12-month period shall not exceed the total fees paid by you in that period
• Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud

12. Indemnity

You agree to indemnify and hold harmless Marvanova from any claims, losses or damages arising from your use of Lucuma in breach of these terms or applicable law.

13. Termination

We may suspend or terminate your account if you breach these terms, fail to pay, or if we are required to do so by law. We will give reasonable notice except where the breach is serious or unlawful. On termination you lose access to the service and your account data will be deleted in accordance with our Privacy Policy.

14. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to these terms

We may update these terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after changes take effect constitutes acceptance.
